Mandatory information about my setup:

Joomla! version: 2.5.14
PHP version: 5.3
MySQL version: (unknown)
Host: windows iis 7
Akeeba Backup version: 3.8.2 Pro

Description of my issue:
I have installed and setup akeeba backup. It is working correctly for local and rackspace use.

I am wanting to set up unattended cron.

However, the akeeba-backup.php script is not present in my joomla cli folder.

Is this a defective install or is the file located elsewhere?

Is it safe for me to just copy it from the installation zip file?

That is the correct location for the file. Please install Akeeba Pro again. Just install it over what is there, do not uninstall the component.
