Description of my issue:
akeeba kickstart is effecting an 403 error and tells me i got no permissions to open it. had you ever heard of this?

Please note that your question is phrased very ambiguously, so I am taking a very wild guess about what you mean. I assume that you can not access kickstart.php when you type http://www.example.com/kickstart.php. In this case there are two things to consider:
a. Your .htaccess file, if present, may be disallowing you from accessing kickstart.php. Please note that if you try to restore a site in a subdirectory then the parent directory's .htaccess is in effect as it is inherited!
b. If you give kickstart.php 0775 or 0777 permissions, some hosts will deny running it. In this case you have to use 0644 permissions and remove kickstart.php manually after the restoration is over.

Side note: if the archive has already extracted and you get a 403 when you click the "Run the Installer" button or when trying to restore the database then you are NOT in Kickstart and your question is phrased incorrectly. In this case you will have to explain me, in great detail, everything you have done up to the point of receiving a 403 and a screenshot of the error message.

now the.jpa is not able to be opened by kickstart.php

do you know this too, maybe?

i changed all permissions to 777 and php user but this doesnt work. i never had a problem with akeeba but today it wont work :-(

I wen through the entire installation. Besides, if you have a session issue, our troubleshooter does have a related article. Please read the troubleshooter. I can't help you if you don't do that much. I don't enjoy paraphrasing myself :)

the backup isnt loaded, its just the old site.
